TERMS AND CONDITIONS

Scope
The GTC apply to all services provided by the sole proprietorship Mauro "OYUKUMA" Baumann in the online store (www.oyukuma.ch) and become valid upon conclusion of a contract. The deliveries, services and offers of Mauro "OYUKUMA" Baumann are exclusively based on these GTC, even if they are not expressly agreed again. By sending an order to Mauro "OYUKUMA" Baumann, you confirm that you have read these GTC and expressly agree to them.

Conclusion of a contract
All information about goods and prices within the order process are subject to change and non-binding. Purchase contracts are concluded by acceptance of your order by Mauro "OYUKUMA" Baumann. The acceptance of the order will be confirmed to you by OYUKUMA via e-mail and is subsequently binding for you. Delivery obstacles will also be communicated to you as soon as possible by e-mail. You confirm with your order that you are clear about the scope and content of your order. Questions in this context can therefore be clarified in advance with us.

Delivery
The delivery of the goods is generally made by mail or courier. The delivery time in Switzerland is usually 2 to 5 working days, unless otherwise written in the respective product. This information is without guarantee. For deliveries abroad, the delivery time depends on the location of the recipient. In the EU we ship our shipments DDP which means no additional fees/customs charges for the customer. For other shipping locations abroad, additional taxes and duties may apply at the border, which are generally the responsibility of the customer.

If the sender does not provide the correct address or an address where the post office cannot locate the person, then the return shipping costs charged by the post office must be borne by the customer.

Should an article of the assortment exceptionally not be available, we will inform you as soon as possible via e-mail. In principle, Mauro "OYUKUMA" Baumann reserves the right to make a partial delivery, provided that this seems to be conducive to an efficient processing of the overall delivery. Of course, in such cases, no additional shipping costs will be charged for the subsequent delivery. In addition, Mauro "OYUKUMA" Baumann reserves the right to demand an advance payment of 100% for deliveries abroad.

Prices
All prices on www.oyukuma.ch are exclusive of shipping costs. The effective shipping costs will be displayed in the shopping cart before the order is completed. Finelli GmbH expressly reserves the right to adjust the prices shown online at any time without notice and without further explanation. For the calculation of the prices, the time of the order on the website is valid. 

Shipping costs
Are calculated on the basis of the current prices of DPD and in addition the packaging costs.

Retention of title; set-off; right of retention

(1) In the case of consumers, we retain ownership of the purchased item until the invoice amount has been paid in full. If you are an entrepreneur exercising your commercial or independent professional activity, a legal entity under public law or a special fund under public law, we shall retain title to the purchased item until all outstanding claims arising from the business relationship with the customer have been settled. The corresponding security rights are transferable to third parties.

(2) You shall only have a right of set-off if your counterclaims have been legally established or are undisputed or acknowledged by us. Furthermore, you shall only have a right of retention if and to the extent that your counterclaim is based on the same contractual relationship.

(3) If the customer is in default with any payment obligations towards us, all existing claims shall become due immediately.

Guarantee and warranty
The warranty for goods corresponds to generally accepted standards and is 12 months, unless a longer or shorter warranty period is expressly stated on the delivered goods. Defective goods must be reported in writing to the company address within 10 days of delivery or after the damage has occurred, otherwise the warranty claim is void. The warranty claim is valid from the date of delivery. It expires in case of improper use or natural wear. The bag should not be loaded with more than 5 kilograms. Mauro "OYUKUMA" Baumann reserves the right to decide individually in case of warranty.

Return guarantee
Every buyer has the right to return the items received to Mauro "OYUKUMA" Baumann within 10 days (deadline: receipt of the goods). For returns and exchanges, the items must be returned in perfect hygienic condition, otherwise the right to exchange or return expires. The return costs must be borne by the buyer.

Minor model deviations
It happens that the design of individual articles changes slightly. By its very nature, Mauro "OYUKUMA" Baumann cannot accept any liability for such modifications made by manufacturers and suppliers.

Care/Handling
Mauro "OYUKUMA" Baumann assumes no liability for the misconduct of the customer in the care and / or handling of the delivered items.

Privacy
Mauro "OYUKUMA" Baumann undertakes to process your customer data carefully and to observe the provisions of the relevant data protection legislation. In particular, no data will be disclosed to third parties. However, no liability can be accepted for the security of data transmitted via the Internet.

Marketing
Mauro "OYUKUMA" Baumann reserves the right to reuse the e-mail address and telephone number provided with the order for its own marketing purposes (newsletter & Further). By sending a personal email to support@oyukuman.ch you can opt out of this.

Reviews of products
OYUKUMA sends automated e-mails after the purchase, asking customers to rate the purchased products. Mauro "OYUKUMA" Baumann reserves the right to use these reviews, as well as any other reviews (without an email request), for marketing purposes.

Vouchers
Personal vouchers created only for a specific person or for a specific group may not be shared and may only be redeemed by Mauro "OYUKUMA" Baumann authorized persons. Mauro "OYUKUMA" Baumann reserves the right to cancel any unauthorized orders without comment. Only one discount code may be used per order.

Costs in case of late payment
Processing fee (from day 70 after invoice date at the earliest, when handed over to collection service provider) depending on amount of claim in CHF 37 (up to 19); 58 (up to 59); 145 (up to 399); 225 (up to 999); 285 (up to 1'999); 385 (up to 2'999); 575 (up to 4'999); 685 (up to 6'999); 825 (up to 9'999); 1'375 (up to 19'999); 2'600 (up to 49'999); 6% of claim (from 50'000).

Liability in general
It is hereby expressly pointed out that no liability claims can be made against Mauro "OYUKUMA" Baumann for indirect damage or consequential damage of the customer, insofar as there is no damage caused by Mauro "OYUKUMA" Baumann intentionally or through gross negligence. So in particular damages from accidents, etc. from the handling of hardware (bags, etc.) are in your own responsibility.

Change AGB
Mauro "OYUKUMA" Baumann expressly reserves the right to unilaterally change these terms and conditions at any time without prior notice.

Applicable law/place of jurisdiction
In any case, the relationship between you and Mauro "OYUKUMA" Baumann is subject to Swiss law according to the provisions of the Swiss Code of Obligations (OR) and the Swiss Civil Code (ZGB). The place of jurisdiction is Switzerland. The application of the provisions of the Vienna Sales Convention ("United Nations Convention on Contracts for the International Sale of Goods") is expressly excluded.
